1. Provider and Scope of Application
These Terms of Use apply to the use of the WODOTO mobile app and the functions, content, and services provided through it.
The provider of the app is:

Email: support@wodoto.app

These Terms of Use apply to all users of the app.
Any deviating or supplementary terms and conditions of individual users shall apply only if WODOTO has expressly agreed to them.
2. Purpose of the App
WODOTO is an app for the digital management and organization of work-related information, particularly in the fields of working at heights, rope access, industrial climbing, and related activities.
The specific range of functions may vary depending on the app version, platform, operating system, user role, subscription plan, availability, and technical development.
WODOTO provides a technical platform. WODOTO does not undertake to ensure the conclusion of specific contracts, the arrangement of specific assignments, a particular number of contacts, the accuracy of user information, or the success of an application, inquiry, or collaboration.
3. Relationship with App Stores
The download, installation, updating, and, where applicable, payment processing of the app take place through the respective app store, in particular the Apple App Store or Google Play Store.
The terms and conditions of the respective store operator also apply to downloading, using the respective store, in-app purchases, subscriptions, refunds, and payment processing.
To the extent that these Terms of Use deviate from mandatory terms and conditions of the respective store operator, the mandatory provisions of the store operator shall remain unaffected.
WODOTO is not the operator of the Apple App Store or Google Play Store and does not have full control over their technical, contractual, or payment-related processes.
4. Registration and Conclusion of the Contract
Creating a user account is required to use essential functions. The user enters the required registration details and accepts these Terms of Use. Upon completion of the registration, a usage contract is concluded between the user and WODOTO.
WODOTO may make the use of individual functions dependent on email verification, profile completion, role verification, approval, consent from legal representatives, or other technical or organizational requirements.
There is no entitlement to registration, activation, retention of specific functions, or admission to specific user groups, unless otherwise required by law.
If WODOTO offers paid functions, in-app purchases, subscriptions, or other paid digital services, the user will be informed, before completing the purchase, about the essential characteristics of the service, the price, the term, any automatic renewals, cancellation options, and other material contractual terms.
A contract for paid content or functions is concluded only when the user completes the respective paid ordering process and the purchase is confirmed by the respective app store, in particular the Apple App Store or Google Play Store. Payment processing takes place through the respective app store. The terms and conditions of the respective store operator also apply.
5. Underage Users and Conclusion of the Contract
Minors may use WODOTO and become contracting parties to the extent permitted under applicable legal provisions.
Minors who have not yet reached the age of seven may not register their own user account or independently become contracting parties to WODOTO. Minors who have reached the age of seven have limited legal capacity. Where the consent of legal representatives is required for registration, use of paid functions, publication of profile information, contacting other users, participation in the job board, sharing of certificates, or other legally significant actions, such consent must be obtained in advance.
By registering or using the app, the minor user confirms that any required consent from their legal representatives has been obtained or that the respective use is legally permitted without such consent.
WODOTO may make the use of individual functions dependent on proof of age, confirmation or consent from legal representatives, or additional verification procedures. This applies in particular to paid functions, public profile visibility, sharing of certificates, job board functions, contact functions, and functions through which personal data, contact details, or documents are made visible to other users.
Legal representatives are responsible for supervising the use of the app by minor users and ensuring that information, documents, certificates, contact details, sharing permissions, and job board activities are lawful and accurate.
Minors may use paid functions, in-app purchases, or subscriptions only if they are authorized to do so, in particular if any required consent from their legal representatives has been obtained or if the service is paid for using funds provided to them for this purpose or for their unrestricted use. The terms and conditions of the respective app store also apply.
WODOTO may restrict functions for minor users or provide additional protective measures, particularly with regard to public visibility, contacting other users, the job board, telephone numbers, email contact, sharing of certificates, or promotional content.
6. User Groups and Requirements for Use
The app is intended in particular for individuals and companies operating in the fields of working at heights, rope access, industrial climbing, project work, personnel placement, assignment planning, or related areas.
Where app functions involve professional, commercial, or safety-related information, the user is obliged to provide truthful, up-to-date, and complete information. This applies in particular to qualifications, certificates, rope access levels, references, availability, professional experience, and contact details.
7. User Account and Login Credentials
The user is obliged to keep their login credentials confidential and protect them against access by third parties. The user account may not be transferred to third parties or made available for use by third parties without the consent of WODOTO.
The user is obliged to inform WODOTO without undue delay if there are indications that their user account has been misused or that their login credentials have become known to unauthorized third parties.
WODOTO is entitled to implement technical and organizational measures to protect user accounts against misuse. These include, in particular, email verification, security checks, temporary suspensions, password resets, or restrictions on individual functions.
8. User Obligations
The user undertakes to use the app only in accordance with applicable law, these Terms of Use, and the intended app functions.
In particular, the following are prohibited:
- Providing false, misleading, or incomplete information about oneself, one’s qualifications, professional experience, certificates, or availability;
- Misrepresenting the identity of another person or company, or falsely claiming qualifications or authorizations;
- Uploading forged, manipulated, or unauthorized certificates, proof of qualifications, references, or documents;
- Violating third-party rights, in particular copyrights, trademark rights, personality rights, data protection rights, or trade secrets;
- Posting unlawful, insulting, discriminatory, threatening, pornographic, violence-glorifying, extremist, fraudulent, or otherwise impermissible content;
- Harassing, pressuring, deceiving, or contacting other users in an abusive manner;
- Sending spam, chain messages, mass advertising, or unsolicited advertising;
- Using malware, scripts, automated queries, scraping tools, or other technical attacks;
- Bypassing security mechanisms, access restrictions, or technical protective measures;
- Using the app for purposes other than those intended, in an abusive manner, or in a way that disrupts its operation;
- Uploading content that the user is not authorized to upload;
- Storing, copying, disclosing, or using other users’ data outside the intended app functions without a legal basis;
- Posting job offers, project inquiries, or contact requests that violate legal requirements, third-party rights, or these Terms of Use.
9. Profile, Visibility, and Sharing Permissions
Users can create a profile in WODOTO and provide certain information about themselves, their professional activities, qualifications, references, certificates, and availability.
The visibility of individual profile details depends on the user’s settings, contact status, public profile sharing, certificate sharing, and the app functions available in each case.
The user is responsible for deciding which voluntary information to include in their profile and which sharing permissions to grant. Public profile sharing or certificate sharing should only be enabled if the user agrees to the respective visibility and use of the information.
For minor users, public profile sharing, contact information, certificate sharing, and job board activities should only be used with particular care and, where required, with the consent of their legal representatives.
WODOTO may restrict the visibility of certain information if this is necessary to protect users, particularly minor users, prevent misuse, or comply with legal requirements.
10. Contact Function
Users contact one another within the app. Users can search for other users, contact them, or accept them as colleagues, insofar as the respective function is available.
Certain contact options, such as email or telephone contact, may be available to accepted colleagues, insofar as this is provided for by the app function and the sharing settings.
The user is obliged to contact other users only in an appropriate and lawful manner and within the scope of the intended functions. Unsolicited advertising, harassment, exerting pressure, deception, or abusive contact are prohibited.
WODOTO does not guarantee that any particular user will be found, contacted, commissioned, or referred.
11. Integrated Job Board
WODOTO includes an integrated job board. Through the job board, users can post and view job offers, project inquiries, or work-related information, or get in touch with other users.
Contact in connection with the job board takes place exclusively within the app. Contact details are passed on directly to other users only to the extent provided for by the profile, contact, or sharing settings.
WODOTO provides the technical platform for the job board. As a general rule, WODOTO is not a party to contracts, assignments, employment relationships, service agreements, contracts for work, or other legal relationships that arise between users as a result of contact initiated through the app.
Users are themselves responsible for:
- Keeping job offers, project inquiries, and profile information accurate, complete, and up to date;
- Complying with legal requirements relating to job advertisements, assignments, employment, self-employment, temporary agency work, occupational health and safety, remuneration, taxes, and social security;
- Verifying the identity, qualifications, availability, and suitability of the respective contractual partner before commissioning work or entering into a collaboration;
- Obtaining and verifying any required permits, certificates, insurance policies, or supporting documents;
- Complying with the legal requirements concerning the protection of minors, the protection of young people at work, the conclusion of contracts, and the consent of legal representatives when dealing with minor users.
WODOTO makes no guarantee as to the accuracy, completeness, currency, lawfulness, or quality of job offers, profile information, references, certificates, or other user-provided information.
A job is deleted when the user deletes the job or their user account is deleted, unless statutory retention obligations or legitimate reasons for further storage apply.
12. Documents, Certificates, References, and Files
Users can upload documents, certificates, references, images, and other data to WODOTO. WODOTO is entitled to restrict upload options to certain file formats (e.g., PDFs).
The user is solely responsible for:
- Uploading only files that they are authorized to store and use;
- Not uploading any impermissible or unlawful content or content that infringes third-party rights;
- Not uploading unnecessary sensitive or confidential information;
- Ensuring that uploaded certificates, supporting documents, and references are authentic, up to date, and accurate;
- Checking which persons can view the respective files before granting access;
- Ensuring that the required consent of legal representatives has been obtained for documents belonging to minor users. Their own data protection obligations remain unaffected.
As a general rule, WODOTO does not substantively review uploaded documents, certificates, or references for authenticity, accuracy, completeness, or currency, unless a separate review or verification function is expressly offered.
WODOTO may remove or block files or restrict their visibility if there are indications of legal violations, misuse, security risks, or violations of these Terms of Use.
13. User Content and Grant of Rights
As a general rule, the user retains their rights to the content they post, in particular profile texts, images, documents, references, job offers, messages, and other files.
However, the user grants WODOTO a simple, non-exclusive, territorially unrestricted right, for the period necessary for the use of the app, to technically store, reproduce, process, display, transmit, and make accessible the content posted by the user, to the extent necessary to provide the app and the functions selected by the user.
This includes, in particular, displaying profile information, contact information, references, certificates, job offers, messages, and files to other users, insofar as this is provided for by the app functions, sharing permissions, or visibility settings.
The user warrants that they hold the rights required for these purposes and that their use of the app does not infringe any third-party rights.
14. Prohibited Content
No content may be posted, transmitted, or shared in the app that violates applicable law, third-party rights, or these Terms of Use.
In particular, the following content is prohibited:
- Content that is criminal, fraudulent, or unlawful;
Content that violates personality rights, data protection rights, or confidentiality obligations; - Content that infringes copyrights, trademark rights, or other third-party rights;
Content that is discriminatory, insulting, defamatory, threatening, or harassing; - Content that contains extremist, violence-glorifying, or dehumanizing material;
- Content that is pornographic or harmful to minors;
- Content that contains malware, phishing, spam, or technical attacks;
- Content that contains false qualifications, forged certificates, or misleading professional information;
- Content that contains impermissible advertising or unsolicited direct contact.
15. Reporting Content and Misuse
Users can report unlawful or impermissible content, as well as misuse, through the reporting channels provided in the app or by email to WODOTO.
Contact for reports: support@wodoto.app
WODOTO reviews reports appropriately and may take necessary measures, including removing content, restricting visibility, issuing warnings to users, restricting functions, or suspending user accounts.
16. Moderation, Suspension, and Measures in the Event of Violations
WODOTO is entitled to review, remove, or block content, restrict visibility, issue warnings to users, restrict functions, temporarily or permanently suspend user accounts, or terminate the usage contract if there are specific indications that:
- These Terms of Use have been violated;
- Legal provisions have been violated;
- Third-party rights are affected;
- Security risks exist;
- The app is being used abusively;
- False, misleading, or dangerous information has been provided;
- Other users need to be protected;
- Minors need special protection;
- WODOTO is legally required to take such action.
WODOTO will inform affected users about significant measures, insofar as required by law and provided that no overriding security, misuse prevention, or law enforcement interests stand in the way.
Affected users may submit objections to a moderation decision or suspension by email to WODOTO.
17. Special Responsibility for Safety-Critical Activities
WODOTO may contain information regarding qualifications, certificates, rope access levels, references, and professional experience. This information may be relevant to safety-critical activities.
However, WODOTO does not provide any professional, legal, or technical safety assessment of the suitability of individual users, certificates, references, or job offers, unless a separate assessment service has been expressly agreed upon.
Users, clients, and companies are themselves responsible for verifying all required qualifications, certificates, insurance policies, employment law requirements, safety requirements, occupational health and safety regulations, and legal requirements before commencing any activity.
WODOTO does not replace a professional assessment, an occupational health and safety evaluation, assignment planning, or legal advice.
18. Advertising in the Job Board
Advertising from third-party providers may be displayed in the job board.
Users are not entitled to have specific advertisements displayed or not displayed, unless otherwise required by law.
Commercial advertisers or third-party providers wishing to place advertisements through WODOTO may only provide lawful, truthful, and non-misleading advertising content. They are solely responsible for the legality of their advertising.
WODOTO may reject, remove, or block advertising content if it violates applicable law, third-party rights, youth protection requirements, these Terms of Use, or the legitimate interests of WODOTO.
19. Push Notifications and Communication
WODOTO may inform users about important matters through in-app notifications, push notifications, email, or other suitable means of communication. These include, in particular, notifications concerning user accounts, security, contact requests, messages, job board functions, changes to the contract, technical disruptions, or updates.
Push notifications may be delivered through third-party services. Details regarding data processing are set out in the Privacy Policy.
Promotional push notifications will only be sent where there is a legal basis for doing so, in particular where the required consent has been obtained.
20. Data Protection
Information about the processing of personal data is provided in the WODOTO Privacy Policy. The Privacy Policy is available in the app or on the WODOTO website.
21. Availability and Technical Changes
WODOTO strives to provide the app reliably. However, uninterrupted availability at all times is not guaranteed.
Availability may be restricted in particular due to:
- Maintenance work;
- Updates;
- Technical disruptions;
- Security measures;
- Force majeure;
- Disruptions affecting third-party providers;
- App store processes;
- Network or device problems on the user’s side.
WODOTO is entitled to further develop the app, modify, add, restrict, or discontinue functions, provided that this is reasonable for the user and WODOTO has legitimate interests in doing so. This applies in particular to security improvements, technical developments, legal requirements, misuse prevention, or business-related adjustments.
Significant changes that substantially affect existing paid services will be communicated to users in an appropriate manner.
22. Updates
WODOTO may provide updates to improve the app, fix errors, close security vulnerabilities, ensure compatibility, or implement legal requirements.
Users should install available updates to ensure the security, stability, and functionality of the app. If a user does not install required updates, individual functions may be restricted or may no longer function properly.
To the extent required by law, WODOTO will provide updates necessary to maintain the app’s conformity with the contract.
23. Paid Functions, In-App Purchases, and Subscriptions
The app may contain free and paid functions. Paid functions, in-app purchases, or subscriptions will be appropriately identified before the purchase is completed.
As a general rule, payment processing takes place through the respective app store, in particular the Apple App Store or Google Play Store. The terms and conditions of the respective store operator also apply to payment, duration, renewal, cancellation, and refunds.
Subscriptions will renew for the period specified in the terms and conditions of the respective app store, unless the user cancels the subscription in good time through their app store account.
WODOTO may restrict or terminate access to paid functions if payment is not made, the purchase status cannot be confirmed, a subscription ends, or misuse occurs.
Minors may use paid functions only to the extent that they are legally entitled to do so and any required consent from their legal representatives has been obtained.
The price list valid at the time the contract is concluded shall apply.
24. Right of Withdrawal for Consumers
Consumers may generally have a statutory right of withdrawal when concluding a paid contract for digital services.
The details of the right of withdrawal, the withdrawal period, possible exceptions, and the expiry of the right of withdrawal are governed by the applicable statutory provisions and the relevant information provided at the time the contract is concluded.
Where a purchase is made through the Apple App Store or Google Play Store, withdrawal, refunds, or cancellation must generally be handled through the respective store operator, insofar as provided for by its terms and conditions.
WODOTO will separately inform consumers of their right of withdrawal to the extent required by law.
25. Intellectual Property Rights in the App
All rights to the app, software, design, trademarks, logos, databases, texts, structures, functions, and other components of WODOTO are held by WODOTO or the respective rights holders. The user is granted a simple, non-exclusive, non-transferable, and revocable right to use the app in accordance with these Terms of Use and the app store terms and conditions. In particular, the following are prohibited:
- Copying, modifying, decompiling, reverse engineering, or otherwise altering the app, insofar as this is not permitted by law;
- Removing intellectual property notices, notices, logos, or labels;
- Exploiting the app commercially outside its intended functions;
- Systematically extracting data from databases or content;
- Using the app abusively to develop competing services.
26. Liability of WODOTO
WODOTO shall be liable without limitation in cases of intent and gross negligence, for injury to life, body, or health, under the German Product Liability Act, and to the extent that an express guarantee has been given.
In cases of ordinary negligence, WODOTO shall be liable only for breaches of material contractual obligations. Material contractual obligations are those obligations whose fulfillment is essential to the proper performance of the contract and on whose compliance the user may regularly rely. In such cases, liability shall be limited to foreseeable damage typical for the contract.
In all other respects, liability is excluded to the extent permitted by law.
WODOTO shall not be liable for the accuracy, completeness, lawfulness, currency, or quality of user content, job offers, profile information, certificates, references, documents, or other information provided by users.
WODOTO shall not be liable for contracts, assignments, employment relationships, collaborations, damages, or disputes arising between users or between users and third parties as a result of contact initiated through the app, unless WODOTO is responsible for such matters under mandatory law.
WODOTO shall not be liable for damages arising from users or third parties relying without verification on certificates, references, qualification details, job offers, or other user-provided information, unless WODOTO is responsible for such damages under mandatory law.
27. User Liability and Indemnification
The user is liable for all content, information, and actions carried out through their user account, to the extent that they are responsible for them.
The user shall indemnify WODOTO against third-party claims asserted as a result of the user’s culpable violation of these Terms of Use, statutory provisions, or third-party rights. This also includes reasonable costs of legal defense.
- The indemnification obligation applies in particular to claims arising from:
- Unlawful content;
- False qualification or certificate information;
- Infringement of copyrights, trademark rights, or personality rights;
- Data protection violations;
- Impermissible advertising;
- Abusive contact;
- Unlawful job offers or project inquiries;
- Violations of requirements relating to the protection of minors, the protection of young people at work, or the consent requirements applicable to legal representatives.
The statutory liability rules apply to minor users. To the extent permitted by law, legal representatives may also be held responsible if they initiated or permitted the use or breached their supervisory duties.
28. Term and Termination
The usage contract is concluded for an indefinite period, unless a fixed-term or paid service has been agreed separately.
The user may delete their user account at any time using the app functions or contact WODOTO to request deletion.
WODOTO may terminate the usage contract by giving reasonable notice, unless otherwise provided by applicable statutory or contractual provisions.
The right to extraordinary termination for good cause remains unaffected. Good cause exists in particular if the user seriously or repeatedly violates these Terms of Use, posts unlawful content, endangers other users, uses forged certificates, circumvents security mechanisms, misuses the app, or fails to obtain required declarations of consent.
Upon deletion of the user account, the associated data will be deleted in accordance with the Privacy Policy, unless statutory retention obligations apply or legitimate reasons for further storage exist.
29. Changes to the Terms of Use
WODOTO may amend these Terms of Use if such amendments are necessary due to technical, economic, or legal developments and are reasonable for users.
WODOTO will inform users of significant changes in an appropriate manner, for example, within the app or by email. If the user does not wish to agree to the amended terms, they may terminate or delete their user account.
Amendments that unreasonably disadvantage the user will not be made without express consent, insofar as required by law.
For minor users, WODOTO may, where necessary, obtain the consent of their legal representatives to the amended terms or restrict individual functions until the matter has been clarified.
30. Support and Communication
Support requests may be sent to the following address:
WODOTO may inform users about important matters through in-app notifications, push notifications, email, or other suitable means of communication, in particular regarding user accounts, security, contact requests, job board functions, changes to the contract, or technical disruptions.
31. Applicable Law
The laws of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
In relation to consumers, this choice of law shall apply only to the extent that it does not restrict mandatory consumer protection provisions of the country in which the consumer has their habitual residence.
32. Place of Jurisdiction
To the extent that the user is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction shall be the registered office of WODOTO.
For consumers, the statutory places of jurisdiction shall apply.
33. Dispute Resolution
WODOTO is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board, unless legally required to do so.
Regardless, WODOTO endeavors to resolve disputes with users directly and objectively. Users may contact WODOTO for this purpose using the contact address provided above.
34. Final Provisions
If any provision of these Terms of Use is or becomes wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
The invalid provision shall be replaced by the applicable statutory provisions.
The current version of these Terms of Use is available in the app or on the WODOTO website.
